We may collect a range of Personal Information, but we primarily have access to and/or collect information that you voluntarily provide us as is necessary for providing our Site and our products and services. Please note, we do not digitally analyze any data for any biometric identification purposes.
- Demographic Data: Evolving Solutions may also collect demographic information for our internal business purposes, but this is stored on an anonymous basis which is not unique to you, such as your age and gender.
- Business-to-Business Context: You may be required to provide certain Personal Information to us when you elect to acquire our products or services from us through an Agreement (defined below). These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. If you or your company purchases Evolving Solutions’ products and services, that purchase will be governed by either an agreement with you or your company or our online Terms of Service (collectively “Agreement”). To provide our products and services, we collect billing and credit card information. This information is used to complete the purchase transaction as may be further specified in the Agreement.
We also may collect additional personal or non-personal information in the future and our Privacy Policy will be updated accordingly.
Sources of Personal Information
We collect or receive, and in the past 12 months, may have collected or received Personal Information from the following sources:
- Directly from you when you provide it to us, for example, such as when you contact Evolving Solutions representatives, request information from us or sign up for events.
- From third parties, such as our Third Party Providers and other service providers, business partners, advertising networks, analytics providers, and search information providers as further described in the section titled “Sharing Information”), who may provide us with Personal Information about you.
- Through tracking technologies, automatically and indirectly from you as you navigate through the Site, including usage details, information from logging and analytics tools, pixel tags, and other similar technologies, and information collected through cookies.

Sharing Information
Evolving Solutions does not sell, rent, or lease Personal Information or its customer lists to third parties.
We may share your Personal Information in the following circumstances and to the following third parties:
- Affiliates: We may share Personal Information with our affiliates who need access to the information to perform business-related functions and services.

- Business Partners: From time to time, Evolving Solutions may contact you on behalf of external business partners about a particular offering that may be of interest to you. Cookies and Other Tracking Technologies
Evolving Solutions and our Third Party Providers may use cookies and similar tracking technologies to enhance your online experience, analyze Site usage, and support personalized content and advertising.

Evolving Solutions does not control these third parties’ data practices. AI and Automated Decision-Making

Security is a high priority for Evolving Solutions. These measures include access controls, secure servers, encryption technologies, and other commercially reasonable security procedures. We honor browser-based opt-out signals where required by law, such as the Global Privacy Control (GPC).
We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy and as long as needed to process your requests, to operate our business, to provide our products and services, and as long as we are legally obligated to keep it. The length of time we retain Personal Information depends on factors such as:

Because Evolving Solutions operates in the United States and does not target or serve international clients, this Privacy Policy is intended to comply with applicable U.S. privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and similar state privacy laws where applicable.
Depending on where you live and applicable law, including residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, you may have certain additional rights regarding your Personal Information under applicable data protection laws. Upon receiving a verifiable request from you, we will comply with applicable legal obligations and respond consistent with your rights as follows:

- Right to Limit: You have the right to opt out of any ancillary use of your Personal Information (e.g., for marketing purposes).
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights under applicable law.
- Right to List of Third Parties: You have the right to obtain a list of the specific third parties to which we have disclosed your Personal Information.
Please contact us (as specified below) to request any of the above rights. You will be required to verify your identity before we are able to fulfill your request. Upon confirmation that you are making a lawful request, we will confirm our obligations under applicable law. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us. We will acknowledge your request and respond to your request (upon verification) in accordance with the response time required by applicable law. In some jurisdictions, you may have the right to appeal our action with regard to your request for any of the above rights by contacting us at the email specified below.
Please note that we may not be able to comply with certain requests if doing so would prevent us from:
- Completing a transaction or providing a requested service;
- Detecting or protecting against security incidents, fraud, or illegal activity;
- Debugging or repairing system errors;
- Complying with a legal obligation;
- Conducting scientific, historical, or statistical research in the public interest, when deletion would seriously impair research results (with your consent where required); or
- Using Personal Information internally in a lawful manner consistent with the context in which it was provided.
Please note, in addition to the rights listed above, some jurisdictions may provide a right to consumers that are subject to profiling in furtherance of decisions that produce legal or similarly significant effects. We do not use your Personal Information for profiling purposes.
Further, some states provide a right to opt-out of the sale of Personal Information, using Personal Information for targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell Personal Information, nor do we engage in targeted advertising or profiling, which is why we do not have an opt-out link.
Children Under Thirteen
In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. § 6501.06 and 16 C.F.R. §§ 312.1 – 312.12, Evolving Solutions does not knowingly collect or solicit Personal Information from children under the age of thirteen. By using our Site or acquiring our products or services, you represent that you are not younger than 13. In the event we learn that we have collected Personal Information from a child under the age of 13, we will promptly take steps to delete that information. If you are a parent or legal guardian and think your child has given us their Personal Information, you can email us at info@evolvingsol.com. We have no actual knowledge that we sell or share Personal Information of minors under the age of 16.
E-mail Communications
From time to time, Evolving Solutions may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our products and services, we may receive a notification when you open an email from Evolving Solutions or click on a link therein.
If you would like to stop receiving marketing or promotional communications via email from Evolving Solutions, you may opt out of such communications by unsubscribing from emails by emailing info@evolvingsol.com or clicking on MANAGE PREFERENCES to unsubscribe.
External Data Storage Sites
Personal Information collected by us may be stored and processed in your region, in the United States, or in any other country where we or our Third Party Providers maintain facilities. Generally, the primary storage location is in the United States. Unless otherwise requested by our clients, backups originating from locations within the European Economic Area (EEA) remain within the EEA. Storage locations are chosen to support efficient operations, improve performance, and create redundancies in order to protect the data in the event of a server outage or security incident. Personal Information is processed according to the provisions of this Privacy Policy and the requirements of applicable law regardless of where the data is stored.
We may transfer Personal Information from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do, we use a variety of legal mechanisms, including contracts, to help ensure your rights and protections travel with your data; such contracts will conform to the standard clauses specified under the GDPR and we will remain liable for the protection of such personal data.

Metrics
California law may require us to compile the following metrics for the previous calendar year: the number of rights requests received, complied with, and denied, as well as the median number of days within which we responded to those requests. To the extent this obligation applies to us, we will comply.
California Shine the Light
Under California Civil Code sections 1798.83-1798.84, California residents who have an established business relationship with us are entitled to ask us once a year for information regarding the Personal Information we have shared, if any, with third parties for their direct marketing purposes. If you are a California resident and would like to submit such a request, please submit your request in writing to the address listed in the Contact Information section and include the words “Shine the Light” in your correspondence. The request must include your name, street address, city, state, and ZIP code and an attestation that you are a California resident. We are not responsible for requests that are not labeled or sent properly, or that do not have complete information.
California Do-Not-Track Disclosure
We are committed to providing you with meaningful choices about the information collected through the Site for third party purposes. However, we do not currently recognize or respond to browser-initiated Do-Not-Track signals, as the Internet industry is currently still working on Do-Not-Track standards, implementations, and solutions.
Changes to this Statement
Evolving Solutions reserves the right to modify or update this Privacy Policy from time to time. The current version of this Privacy Policy is as updated in the Update Date referenced above.
